The tip line sits inside payroll, payments, and trust.
A cash jar and a digital tip screen can produce the same employee income and very different records. Who receives the tip, when it is available, how it enters payroll, whether pooling applies, and which wage rules the employer uses are business-system decisions with legal consequences.

Federal tip rules changed after the 80/20/30 rule was vacated, and state law still diverges sharply.
The Department of Labor's December 2024 Federal Register rule removed the vacated 2021 dual-jobs text and restored the earlier regulatory language. The DOL's tipped-employee fact sheet explains federal tip-credit, pooling, and overtime principles, while its state table shows that several states require the full state minimum wage before tips. Employers must confirm current federal, state, and local rules with qualified counsel and payroll advisors.

The employee may receive value quickly, while allocation, pooling, shortages, and employer records need a deliberate process.
Card
Recorded and delayed
The transaction can identify the tip, but settlement timing, payment fees, payroll treatment, reversals, and payout cadence need clear rules.

Do not assume it is a tip
Mandatory charges and voluntary tips can receive different wage, tax, disclosure, and ownership treatment.

Separate operating entities
Hotel, operator, restaurant, and payment-account roles can complicate who collects and who employs the recipient.
Write the money path before choosing the screen

Make four policy choices explicit
Eligibility
Who participates?
Base the answer on actual duties, employer structure, and applicable law rather than job-title shorthand.
Allocation
How is value divided?
Direct assignment, shift pool, role pool, hours, points, or another method should be explainable and consistently applied.
Timing
When can employees access it?
State the payroll or cash cadence and how corrections, chargebacks, or late settlements are treated lawfully.
Evidence
What can each person verify?
Guest amount, transaction, pool total, allocation rule, employee share, and payout should reconcile without exposing private pay data.
Do not use average tip size as the only health measure. Watch participation, method, employee receipt, failed or reversed payments, payout age, unexplained differences, and whether guest prompting remains voluntary and appropriate to the service.
Most importantly, do not let the software default become the policy. The operator must choose the lawful program, document it, communicate it to employees, and configure collection and payroll to match. Inherited ambiguity is still a business decision; it is simply one made without control.
