These Guest Terms of Service (the "Terms") apply to you when you use valet parking services at a property served by a valet operator that uses the Valletto platform, including when you check in a vehicle, request a vehicle, receive text messages about your valet session, or make a payment through a Valletto-powered payment page. By doing any of these things, you agree to these Terms.
Valletto LLC ("Valletto," "we," "us") is a Florida limited liability company with its principal place of business at 1111 Brickell Avenue, Suite 1000, 10th Floor, Miami, Florida 33131.
1. What Valletto Is (and Is Not)
- Valletto provides the software platform that valet operators use to run their operations: ticketing, vehicle requests, text messaging, and payments.
- The valet service itself is provided by an independent valet operator (the "Operator"), not by Valletto. The Operator is identified on your ticket, on the payment page, and on your card statement.
- When you pay, the Operator is the merchant of record. Your card statement will show the Operator's payment descriptor.
- Claims about your vehicle, its condition, service timing, or staff conduct are between you and the Operator. Valletto will reasonably assist by making session records available to the Operator.
2. Payments
- Payments made through the platform are processed by Stripe on behalf of the Operator. Rates, fees, validations, and gratuities are set by the Operator or the property, not by Valletto.
- The amount you authorize is shown before you pay. A receipt is available for every payment.
- If you believe a charge is wrong, contact the Operator first. The Operator's contact details are available on the payment page and on your receipt. Most billing questions are resolved within a few days.
3. Payment Disputes and Chargebacks
Valet sessions on the platform are documented. Depending on the location, records for a session may include vehicle photos, license plate images and readings, check-in and retrieval timestamps, staff activity, payment records, and the text messages sent to your phone.
- Disputing an authorized charge is a breach of these Terms. If you file a payment dispute (chargeback) with your card issuer for a charge that you authorized and for which the valet service was provided, without first attempting to resolve the matter with the Operator, that dispute is a breach of these Terms.
- Evidence will be provided to your bank. The Operator may respond to any dispute by submitting the session's complete documentation to your card issuer.
- Access may be suspended. Following a dispute described above, Valletto and participating Operators may suspend the associated phone number, payment method, or vehicle from valet services at properties served by the platform. We will notify you if this happens. If a dispute is filed while a vehicle is in an Operator's care, the Operator may end the valet session and require that the vehicle be picked up.
- No refunds while a dispute is open. Once a dispute is filed, the disputed amount is held by the card networks and the Operator cannot issue a refund of that charge, even a refund it would otherwise agree to, until your card issuer closes the dispute. Issuer reviews can take up to 90 days.
- Unpaid amounts. If a dispute described above is not reversed, the Operator may refer the amount owed for the services provided to a collection agency, to the extent permitted by law.
- Restoring access. If you contact your card issuer and cancel the dispute, the suspension may be lifted, no referral to collections will be made, and the Operator may then issue any refund or adjustment it determines is appropriate. A disputed charge cannot be resolved by offering another form of payment; the dispute itself must be canceled with your card issuer.
- Your legal rights are not affected. Nothing in this section limits your right under applicable law, including the Fair Credit Billing Act, to dispute unauthorized charges, billing errors, or charges on a card that was lost, stolen, or used without your permission. This section applies only to disputes of charges you actually authorized.
4. Text Messages
Valet sessions use text messages for tickets, vehicle requests, and receipts. Message frequency depends on your session activity. Message and data rates may apply. Reply STOP to stop receiving messages for a session. See our SMS consent policy for details.
5. Privacy
Our Privacy Policy describes what we collect and how we use it, including how vehicle photos are taken by valet staff, how your license plate may be read automatically from those photos and used to match your vehicle to your session, and how long session records are kept. Session documentation described in Section 3 is retained and may be shared with the Operator, payment processors, card networks, and your card issuer in connection with a payment or a payment dispute.
6. Disclaimers and Limitation of Liability
- The platform is provided "as is." To the maximum extent permitted by law, Valletto disclaims all warranties, express or implied.
- Valletto is not liable for the acts or omissions of any Operator, including loss of or damage to vehicles or their contents.
- To the maximum extent permitted by law, Valletto's total liability to you for any claim arising out of these Terms or your use of the platform will not exceed the greater of the amount you paid through the platform in the twelve months before the claim or one hundred dollars ($100).
7. General
- These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
- We may update these Terms from time to time. The "Last updated" date above reflects the current version. Continued use of the platform after an update constitutes acceptance of the updated Terms.
- If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
